This website is operated by Welding Wizard Ltd (referred to as 'us', 'our' 'welding wizard')

By using this website and placing an order you are referred to as our 'customer' or 'you'.

An estimated price for required work is referred to as a 'quote' or 'estimate'

A 'quick quote' or remote quote' is an estimated quote provided by us to you through email or phone.

Site- The place the metalwork will be installed

'Agreement' or 'promise' 'accept' is the legal contract you enter after you agree to accept the quote given to you by us for work that you require. This can be given verbally or in written form.

1. TERMS AND CONDITIONS OF SALE

​We may update these terms & conditions from time to time. We reserve the right to alter these conditions without prior notice. Customers should check for alterations prior to ordering.

Unless otherwise agreed in writing, all orders are subject to these terms and conditions.

If placing an order on behalf of a business you confirm you have the authority to bind that business to these terms.

2. PLACING AN ORDER
2.1 PRICE QUOTES

You can use the form on our website to send information to receive a quick quote. This is our standard quoting process where we provide a remote quote based on the information given to us by you. This information may be in the form of photographs/videos/advice and measurements. We will then provide you with an estimate which may be in the form of a written document, email or verbal communication to a customer.

If you accept the quick quote provided, and granted us permission to proceed with your order, therefore entered into an agreement, we will arrange to visit the site and take exact measurements of our own to ensure accuracy.

If you're unable to send us information for a remote quote and would prefer us to come out and measure up, meaning we will physically visit the site and take measurements for you, to then provide you with a quote, we can arrange this, however, you will be charged our standard call out fee which is £150+ VAT (subject to time and distance). If you accept the quote, this charge will be deducted from your final balance upon completion.

We always aim to provide the most accurate estimate as possible. However, final pricing can only be confirmed once we have attended the site and fully assessed the scope of works. If the scope of works differs from the quote provided, we will advise you as soon as this becomes clear during our visit and a revised quote will be re-issued, which you may accept or decline.

Our price quotes are valid for 14 days, after that time, you can no longer accept the quote and a new quote must be provided. The new quote may be different to the previous quote due to the rise and fall of materials and is out-with our control. If you paid a call-out fee for a quote, it can no longer be deducted from your final balance after this time.

2.2 DEPOSITS

You may be asked to pay a deposit to secure our services. This payment is non-refundable as it is used to pay for materials that we use to get your job started. The remaining balance should be paid upon completion.

2.3 CALL OUT FEE
​

Our standard call out fee is £150+ VAT (subject to time and distance) This is the minimum charge for any site visit, whether for a quotation, install or repair.

If you request us to physically visit the site to measure up for a quote, you will be charged our standard call out fee.
-
If, unforeseen issues or further works are identified during a visit that require a re-quote, which is then declined, the call out fee will still apply.

By requesting a site visit, the customer accepts these terms.

3. CUSTOMER GUARANTEES
3.1 WELDING AND WORKMANSHIP
-
We guarantee all welding & workmanship on the areas we manufacture ourselves (such as metal frames and welds) for a period of 3 years after the date of installation. This guarantee covers only the elements we fabricate in-house and does not extend to third-party products such as locks, hinges, working parts, infill materials, or boards, these are subject to the individual manufacturer's guarantees.

3.2 INSTALLATIONS​​​​​​​​​​​​

We guarantee our installations for 1 year after the date of installation. This does not include metalwork on a supply only basis, where the customer installed the product themselves or had another company/person install it.

3.3 FINISHINGS
-
All of our metalwork that has been galvanised is guaranteed to remain rust-free for 5 years* from the date of installation. . The galvanising process itself is carried out by a third party specialist and they state on their FAQ section: "It’s not uncommon to last more than 70 years but the corrosion rate depends on the elements in the atmosphere. For example in a rural setting where there are less emissions galvanized steel can last 100-150 years but in an industrial or marine location it may last 30-50 years"

If the customer chooses a powder coated finish, we provide a 1 year* guarantee from the date of installation on the coating. This timeframe reflects the nature of the powder coating, which is a cosmetic process, therefore any irregularities would be visible immediately or within days of installation. Should such issues arise within the first year, we will arrange for it to be rectified.

4. WHATS NOT COVERED
​

Working parts including locks, drop bolts, handles and hinges are guaranteed by us for 1 year (parts and labour). Customer is responsible for greasing/oiling moving parts as required

Note – working parts are liable to coatings wearing due to being a working/moving part. This is due to ‘metal on metal’ and is unavoidable.

Working parts e.g. slip bolts or drop bolts. Unfortunately the wear on tear on these areas becomes visible fairly quickly, and it is just part and parcel of having a custom metal gate with working metal parts. These areas can be regularly touched up by the customer if they wish to do so. The galvanising underneath is the main protection layer. So the powder coating that gets worn/scraped from use is only aesthetic.

Should something go wrong please do not attempt to fix or alter it yourself. Any work not carried out by us, without prior written consent, will void any guarantees/warranties.

If under rare certain circumstances we agree for other companies/persons to carry out repairs on our products, quotations must be provided and sums agreed prior to any work commencing.​

We do not guarantee wind or storm damage. Swing gates, especially close boarded types, act as large sails and must not be used in strong winds. If wind resistance is a concern, sliding or open-bar gates are recommended. If gates are damaged during storms, repairs would typically fall under home insurance, not our warranty.

General Maintenance​​​​

Guarantee excludes any areas welded on site Also excludes any areas that have to be drilled / cleaned out after galvanising for specific purposes, for example, lock face plates or screw holes or working areas. The galvanising on these areas is removed when screwing in / cleaning out holes etc.

If the customer has not cared for the product in line with our maintenance advice (particularly if in an industrial or marine location)

Raised weld areas or bumps in the finish may appear after galvanising. This is due to the metal composition and galvanising process, and is not a workmanship fault. Smoothing these would compromise the protective coating and reduce lifespan therefore this would be a reason we would not return it to the third party for re-doing.

5. INSTALLATION CONDITIONS AND GROUND RISK

Our quoted installation cost assumes standard site conditions. The following list of potential factors may require a re-quote for additional costs

Unexpected ground types (rocky, wet, soft, filled with debris).

Hidden services (water, gas, electric, data).
-
Tree/bush removal not advised in advance.

6. DELAYS OR DISRUPTIONS TO INSTALLATIONS
Delayed due to other trades, restricted access, or site traffic not advised in advance may incur extra charges.

7. RETURNS & REFUNDS
Should there be an issue with the finishing (galvanise/ powder coating, the product will be taken back to the third party company by us where they will correct the issue, then we will return with the product for installation.

8. LIABILITY
​

We pride ourselves in caring for our customers property, however, sometimes things happen beyond our control. We will make you aware of any damage as soon as it becomes apparent to us.

Installation Liability While we take great care during installation, we cannot be held liable for: * Fragile or aged roughcast or plaster that crumbles during removal/drilling. * Old or weak walls that crack when drilled. * Reinstatement of roughcast, rendering or stonework unless specifically quoted. Where wall conditions are poor, we will do our best to make good, but further finishing may be required by the customer.

ADDITIONAL COSTS -

We reserve the right to charge any additional costs incurred to the company which are not the companies fault/liability.

This typically involves the following scenarios:
-
Client books surveyor and then is not available and does not cancel the meeting
-
Client agreed to do preparation work that was not completed, and the company send a fitting van to site, which has to be called off.

Any other scenarios where the actions of the client result in additional travel time and site visits

9. PAYMENTS
​​​​​​​​By purchasing goods or services from Welding Wizard Ltd, the buyer agrees to the following terms and conditions unless otherwise agreed in writing before purchase.

Introduction
These terms and conditions (“Terms”) apply to all goods and services provided by Welding Wizard Ltd, a company registered in Scotland, UK, with its principal place of business at Welding Wizard, 5 Monks Lane, Braidwood, Carluke, ML8 5PN.
2.Retention of Title
2.1. All goods, including but not limited to gates, posts, and automation equipment (“Goods”), supplied by Welding Wizard . remain the sole and absolute property of Welding Wizard Ltd. as legal and beneficial owner until such time as the purchaser pays the agreed price in full to Welding Wizard Ltd.
2.2. The buyer acknowledges that they are in possession of Goods solely as a bailee for Welding Wizard Ltd until such time as the full price thereof is paid to Welding Wizard, together with the full price of any other goods the subject of any other contract with Welding Wizard.
2.3. Until such time as the buyer becomes the owner of the Goods, they will store them separately from other goods and ensure that they are clearly identifiable as belonging to Welding Wizard Ltd.
2.4. Welding Wizard reserves the right to repossess any Goods in which Welding Wizard. retains title without notice, if goods are unpaid for and there are no outstanding issues or reasons for non payment. The buyer hereby authorises Welding Wizard. to access the location where the Goods are stored in order to repossess them.
2.5. The right of the buyer to possession of the Goods shall terminate if the buyer commits or permits any act or omission which could prejudice or put at risk Welding Wizard’s ownership of the Goods, or if any amounts owed by the buyer to Welding Wizard are overdue, or if the buyer is declared bankrupt, enters into any arrangement with their creditors, or undergoes any analogous act or proceeding under foreign law.​
3.1. These Terms constitute the entire agreement between Welding Wizard Ltd. and the buyer. Any changes to these Terms must be in writing and signed by an authorised representative of Welding Wizard Ltd.
3.2. These Terms are governed by and interpreted according to the laws of Scotland, UK. Both parties submit to the exclusive jurisdiction of the courts of Scotland, UK.
Payment Terms and Conditions of Welding Wizard Ltd.

Introduction
These payment terms (“Payment Terms”) apply to all goods and services provided by Welding Wizard]., a company registered in Scotland, UK, with its principal place of business at Welding Wizard Ltd, Unit 19 Caldwellside Industrial Estate, Lanark ML11 7SR. These Payment Terms are to be read in conjunction with any other terms and conditions of Welding Wizard.

Payment upon Completion
2.1. All goods and services provided by Welding Wizard Ltd. are to be paid for in full by the buyer upon completion unless terms are otherwise agreed in writing.
2.2. An invoice will be issued upon completion of the services or delivery of the goods. The date of the invoice shall be deemed the date of completion.
2.3. Payments can be made via BACS or payment link provided by us.

Late Payment and Additional Fees
3.1. If the payment is not received in full within 7 days from the date of completion, Welding Wizard. reserves the right to charge an administrative fee to the buyer’s account, to cover additional admin fees of pursuing the payment.
3.2. The administrative fee will be £100+ vat.
3.3. In addition to any administrative fee, Welding Wizard. reserves the right to charge interest on the overdue amount at a rate of 5% per annum above the base rate of The Bank Of England. Interest will accrue on a daily basis from the due date until the date of actual payment, whether before or after judgement.

Miscellaneous
4.1. These Payment Terms constitute an integral part of the agreement between Welding Wizard Ltd.. and the buyer/customer. In case of any conflict between these Payment Terms and any other terms and conditions of Welding Wizard, these Payment Terms will prevail.
4.2. These Payment Terms are governed by and interpreted according to the laws of Scotland and the UK. Both parties submit to the exclusive jurisdiction of the courts of Scotland and the UK.

4. MARKETING/SOCIAL MEDIA
Customer grants us permission for photographs of work to be posted on website/social media for public viewing unless stated otherwise. We always take great care to ensure specific details e.g. house name/number and license plates are hidden.

4. DISPUTES
If you wish to make a complaint about any aspect of your order please send an email to welding.wizard@outlook.com stating the nature of the problem. You must also include any relevant information and we will investigate the matter further.
5. LAW
The Contract and these Conditions shall in all respects be construed in accordance with and be governed by Scots law and the parties
submit to the nonexclusive jurisdiction of the Courts of Scotland.
